Lark & Berry Ltd is the controller of personal information described in this notice unless another service identifies itself as a separate controller. Information we collect

  • Identity and contact details, including name, email, telephone number, delivery and billing address
  • Order, payment-status, delivery, return, repair, appointment and client-service records
  • Product choices, ring size, engraving, design preferences, budget, timing and correspondence
  • Photographs, inspiration files, prompts, stories and generated concepts you choose to submit
  • Marketing choices, newsletter consent and communication history
  • Device, browser, IP address, cookie choices, referral, approximate location and site interaction data
  • Fraud-prevention, security and technical log information

Why we use it

We use personal information to provide products and services, take payment, fulfil and support orders, arrange appointments, respond to enquiries, create and refine design concepts, prevent fraud, keep the site secure, meet legal and accounting obligations, and improve our client experience.

Under UK data-protection law, our principal legal bases are performing a contract or taking steps at your request before a contract; complying with legal obligations; our legitimate interests in operating, securing and improving the business; and consent where required, including optional marketing and non-essential cookies. You can withdraw consent at any time without affecting earlier lawful processing.

AI Atelier and inspiration images

When you use the AI Atelier, your selected design details, prompt or story and any inspiration image are sent securely to Google’s Gemini service to generate a visual concept. The concept is inspiration, not a manufacturing drawing or an automated decision about you. A human designer determines feasibility, pricing and any final design.

Do not upload confidential information you do not want processed or material you do not have the right to use. Avoid including health information, identification documents or personal information about another person without their permission.

An unsubmitted concept is held in your browser session so it can be carried into the designer form. If you request a designer review, the concept, brief, contact details and chosen uploads become part of your enquiry record. We do not use your story or prompt as advertising analytics content.

Appointments, enquiries and communications

WAFEL processes appointment, enquiry and concierge-chat information on our behalf, including conversation transcripts, form answers, uploads, available times, AI-assisted replies, human handoffs, confirmations and team notifications. Shopify processes storefront, customer, order and checkout information. SendGrid may process transactional or verification emails when those features are enabled. Cloudflare provides hosting, security and bot protection, including Turnstile.

Marketing emails are sent only where we have an appropriate permission or another lawful basis. You can unsubscribe through any marketing email or contact us. Service messages about an order, booking, security code or requested enquiry are not marketing messages.

Sharing and international transfers

We share only what is reasonably necessary with service providers and professional advisers that help us operate the website, payments, delivery, communications, client service, security, analytics and design tools. We may also disclose information when required by law, to protect legal rights or in connection with a genuine business reorganisation.

Some providers process information outside the United Kingdom or your home country. Where required, we use recognised safeguards such as adequacy regulations, approved contractual clauses or another lawful transfer mechanism. Payment-card details are processed by Shopify and its payment providers; Lark & Berry does not receive your full card number.

Cookies, analytics and advertising

Strictly necessary cookies support security, your bag, country selection and privacy choices. Analytics and advertising technologies are used only in line with the choices shown in our cookie controls and applicable law. You can reopen Cookie settings from the footer.

We do not sell personal information for money. At the date of this notice, the new storefront does not share personal information for cross-context behavioural advertising. If advertising technology is introduced, this notice and the available opt-out controls must be updated before it is activated.

How long we keep information

We keep order and financial records for the periods required by tax, accounting, consumer and fraud-prevention law. Enquiry, appointment, design and service records are kept while the conversation or client relationship is active and for a limited period afterwards so we can provide continuity, resolve disputes and meet legal obligations.

Marketing records are kept until you unsubscribe or we determine they are no longer needed; we may retain a minimal suppression record so we respect an opt-out. Security logs and provider records are kept for limited operational periods. We delete or anonymise information when it is no longer reasonably required, unless law or a legal claim requires longer retention.

Your rights

Depending on where you live, you may have rights to access, correct, delete, restrict or object to processing, receive a portable copy, withdraw consent and complain to a regulator. UK residents may complain to the Information Commissioner’s Office. Send a request to hello@larkandberry.com; we may need to verify your identity.

Where the California Consumer Privacy Act applies, California residents may also have rights to know the categories and specific pieces collected, correct or delete information, opt out of sale or sharing, limit certain uses of sensitive personal information and receive equal service without discrimination. We do not discriminate because someone exercises a privacy right.

Security, children and changes

We use proportionate technical and organisational measures to protect information, but no internet service can promise absolute security. Tell us promptly if you believe information connected with your account or enquiry has been compromised.

The online store and AI Atelier are not directed to children. A parent or guardian should handle any booking or purchase where age or consent requirements apply. We may update this notice when our services, providers or legal obligations change; the date above identifies the latest version.
